A sale does not normally end your tenancy or automatically entitle the landlord to keep your deposit. The deposit should be accounted for when responsibility for the tenancy passes to the purchaser, so ask for written confirmation of who is holding it and keep your payment records, lease and inspection evidence. The new landlord generally takes over the existing tenancy and should deal with the deposit at the end, subject to any lawful deductions for issues such as rent arrears or damage beyond normal wear and tear. If the deposit is disputed, the RTB’s dispute resolution process can assess the individual facts; consider legal advice for a complex case.
