A tenancy clause may be unfair or unenforceable if it tries to remove rights given by the Residential Tenancies Acts, such as access to the RTB, proper notice before eviction, or the landlord’s obligation to maintain the property. Clauses allowing unlimited inspections, banning all visitors, requiring excessive charges, or imposing unreasonable restrictions may also be questionable, depending on the circumstances. A tenancy agreement can set reasonable rules, but it cannot override statutory protections or discriminate unlawfully. The RTB or a solicitor would assess whether a particular clause is valid based on the agreement and the facts.
