Being evicted does not automatically entitle a landlord to keep your security deposit. A landlord may seek to deduct reasonable amounts for unpaid rent or bills, damage beyond normal wear and tear, or other proven losses linked to the tenancy, but should explain and support any deductions. Do not assume the deposit can be used as your final rent unless the landlord agrees. Ask for an itemised statement and evidence, and keep photographs, receipts and correspondence; if you cannot resolve the issue, the RTB dispute resolution process can decide it based on the tenancy’s facts.
