A new build may qualify for an RPZ exemption, but it is not automatic simply because the property is newly constructed. Generally, the dwelling must meet the legal conditions for a newly built property, including when construction began, and the landlord must be able to support the exemption with evidence. The landlord should tell the tenant why the exemption applies and notify the RTB where required.
