In Ireland, a landlord may generally retain a deposit only to cover rent arrears, unpaid bills, damage beyond normal wear and tear, or other lawful losses. For tenancies starting on or after 9 August 2021, the deposit and any rent paid in advance are each generally limited to one month’s rent, subject to specific exceptions. There is no national government deposit-protection scheme, so the landlord should keep the deposit safely and return it promptly when the tenancy ends, less any properly justified deductions. If the parties disagree, the RTB can consider the evidence and decide the dispute; a solicitor can advise on unusual circumstances.
